Business name: MuggyTea
Article 1 (About these Terms)
These Terms set out the conditions for using the app "Pashaberi" (the "App") provided by MuggyTea (the "Developer").
By installing and using the App, you are deemed to have agreed to these Terms. You can review these Terms at any time on this page and from the App's settings screen under "Terms of Use."
Purchases and downloads from the App Store / Google Play are additionally governed by the terms set by Apple and Google.
Article 2 (Definitions)
| Term | Meaning |
|---|---|
| Photo with sound | A photo taken with the App that has a voice attached |
| Pro | The paid feature set available for purchase inside the App (Article 7) |
| Content | The photos, audio, text, and 4-frame stories that users shoot, record, or enter in the App |
Article 3 (Conditions of use)
- The App runs on devices with iOS 17.0 or later, or Android 8.0 (API 26) or later. We do not guarantee operation on devices that do not meet this.
- The App is free to use. Taking photos, saving, playback, captions, speech bubbles, creating 4-frame stories, and exporting are free of charge, with no limit on how often you use them.
- Using the App requires no account creation and no registration of personal information.
- Communication charges and device storage are borne by the user.
Article 4 (Rights to content)
- The Developer acquires no rights whatsoever to the content users shoot, record, or enter in the App, and never asks you to license it.
- Content is stored on the user's device and is not transmitted to the Developer's server. The Developer cannot view, obtain, or use your content. For the conditions under which content leaves the device, see the Privacy Policy §1 and §6.
- Content may involve people other than the user — the likeness and privacy of the people in a photo, or a third party's voice or music captured in a recording. Please be considerate of other people's rights when using the App.
- Whether to publish or share content on social media or elsewhere is the user's own decision and responsibility.
- Copyright and all other rights in the App itself (the program, screen designs, icons, logos, names, and bundled materials) belong to the Developer or their rightful owners.
Article 5 (Prohibited conduct)
Please refrain from the following when using the App.
- Shooting or recording that infringes the rights of others
- Recording a person's image or voice without that person's consent
- Acts amounting to hidden filming or eavesdropping
- Shooting or recording in places where it is prohibited (facilities, performances, shops, and so on)
- Use aimed at harming another person's honor, reputation, or privacy
- Acts that violate laws or public order and morals
- Analyzing, modifying, decompiling, or disassembling the App's program (except to the extent permitted by law)
- Using Pro features by improperly circumventing the payment system
- Interfering with the operation of the App
If use falling under any of the above causes damage to the user or a third party, the user who engaged in it bears responsibility in accordance with law. This does not exempt the Developer from any liability the Developer bears under law. If a user's willful or negligent breach of these Terms causes damage to the Developer, the user bears responsibility in accordance with law.
Article 6 (A request about shooting manners)
The App is a tool that records voices. A person's voice is a very personal record.
- When photographing or recording someone, please say a word first. We also recommend telling children, in a way appropriate to their age and situation, that you are about to take a photo.
- Please do not publish recorded audio without the consent of the person recorded.
- On many devices sold in Japan, the shutter sound plays even in silent mode — by device manufacturer specification, not by law. The Developer cannot disable it. Please be considerate when shooting in quiet places.
This article is a request so that everyone can use the App comfortably. The scope of your legal obligations is determined by Article 5 and applicable law.
Article 7 (Purchasing Pro)
-
Pro is a one-time purchase. You pay once, with no further charges. It is not a subscription, so no cancellation procedure is needed.
-
This is the only product sold.
Product Contents Pashaberi Pro (one-time purchase) Removes ads / removes the watermark from exports -
Pro is available with a one-time purchase. Check the store’s purchase screen for the price and the amount payable before completing your purchase.
-
Even without purchasing Pro, taking photos, saving, playback, and exporting are all free to use.
-
Payment is processed by Apple or Google. The Developer receives no payment information.
-
After switching devices or reinstalling the app, you can restore your Pro status from "Restore purchases" on the settings screen. You must be signed in with the same store and the same account you used to purchase. Purchases on the App Store and on Google Play are not shared. Pro purchased on the iOS version is never valid on the Android version, and vice versa. This operation restores only the Pro entitlement. It does not restore photos or audio data.
-
If you are under 18, please obtain the consent of a parent or legal guardian before purchasing Pashaberi Pro.
Article 8 (Refunds)
Refund procedures differ depending on the store where you purchased.
- Purchases on the App Store: The procedure is handled by Apple. The Developer cannot process refunds. Please use Report a Problem to Apple.
- Purchases on Google Play: Please first follow the Google Play refund policy. In addition, the Developer may in some cases be able to issue a refund from the Google Play Console. For that, please contact the address in Article 14.
In either case, whether a refund is granted is determined by each store's rules and applicable law. The Developer does not guarantee a refund. Once a refund is made, the Pro features become unavailable (when this is reflected in the app depends on the store's processing).
Article 9 (Advertising)
- While you use the App for free, banner ads are shown at the bottom of the gallery screen and the 4-frame story list screen.
- Ads are delivered by Google (AdMob). We do not serve ads based on behavioral history (personalized ads).
- No ads are shown on the camera screen, the photo detail screen, the editing screen, or the settings screen. No full-screen ads are shown.
- If you purchase Pro, ads are no longer shown.
- The Developer has no involvement in the content of the ads. For problems arising from dealings with an advertiser, please contact the advertiser or Google.
For the information collected for advertising, see the Privacy Policy §2.
Article 10 (Loss of data, and the Developer's liability)
Loss of data
-
Content is stored on the user's device. The Developer keeps no backup of your content.
-
Content may be lost in the following cases, and the Developer has no means to restore it.
- Device failure, loss, or factory reset
- Uninstalling the App
- A save failing because device storage is full
- A defect in the OS or the App
If an OS backup remains, you can restore from it yourself.
-
As of version 1.0.0 the App has no data-migration feature for switching devices. What OS backups cover is set out with conditions in the Privacy Policy §6.
-
We recommend exporting important photos with the share feature and keeping them in another place as well.
The Developer's liability
- The App is provided as is. We do not guarantee that it will run normally on every device or that no errors will occur.
- If damage is caused to a user through a cause attributable to the Developer, the Developer bears responsibility in accordance with applicable law.
- However, because the Developer holds no backup of photos or audio, lost content cannot be restored, and the Developer also cannot recreate or reproduce it in place of restoration.
Article 11 (Changes to and termination of the service)
- The Developer may change, add, or remove features of the App.
- The Developer may end the provision of the App for unavoidable reasons. In that case we will announce it in advance, inside the App or on this site, whenever possible.
- After provision ends, new downloads and re-downloads from the stores may become unavailable.
- The Developer will never remotely delete the photos or audio on your device on the grounds that provision has ended. The App has no server that receives content and no mechanism to remotely operate on the content on your device. However, we do not guarantee operation on future OS versions after provision ends, or use after re-downloading or reinstalling.
- Please export important records as photos or videos before provision ends, and confirm that they open.
Article 12 (Changes to these Terms)
- The Developer may change these Terms to follow changes in law or changes to the App's features. Changes are made in accordance with Article 548-4 of the Civil Code of Japan and other applicable law, where the change is in the general interest of users, or where it is not contrary to the purpose of the agreement and is reasonable in light of the necessity and appropriateness of the change.
- When making a change, we will publish the revised Terms and their effective date on this page, and record it in the revision history at the end.
- For changes disadvantageous to users, we will give notice on this page and inside the App before the effective date.
- Terms changed in accordance with law apply from the announced effective date.
Article 13 (Governing law and jurisdiction)
- These Terms are governed by and interpreted under the laws of Japan. This does not exclude protections under mandatory rules applicable to consumers.
- If a dispute arises between the Developer and a user in connection with the App, the Tokyo District Court or the Tokyo Summary Court is the agreed court of first instance, according to the nature of the claim. However, this does not prevent filing with another court permitted by law, and it is subject to the jurisdictional limits that apply to international consumer contracts.
Article 14 (Contact)
For questions about these Terms, please contact:
The app is developed and run by an individual, so replies may take a few days.
